Tribunal costs orders

In general the rule of thumb is that costs are not awarded in tribunal cases.  As with every rule there are exceptions and it is those exceptions that are of vital importance.  There are specific situations in which costs will be awarded but these are like set pieces of play in football and are easy to recognise and these are of no concern for our present purposes.

What is of concern are the situations in which the tribunal could make a discretionary award of expenses within the normal course of play.

Costs can be made if the tribunal considers a party has in bringing the proceedings acted vexatiously, abusively or disruptively or otherwise unreasonably.  Costs may be awarded against the paying party where the bringing or conducting of the proceedings has been misconceived.  Costs may be awarded against the paying party or his representative where they have behaved vexatiously, abusively, disruptively, or otherwise unreasonably.
